Litigation finance: The risks (and how to mitigate them)
In Part 3 of our series on Litigation Finance, we explore the risks and pitfalls of this world, and tell you how to mitigate them.
Investing in intellectual property (IP) involves acquiring, managing, and monetizing intangible assets such as patents, trademarks, copyrights, and trade secrets.
Valuing IP can be complex due to its intangible nature, and there are legal risks associated with infringement disputes and litigation. Managing and protecting IP requires ongoing investment in legal and administrative processes.
Examples of successful IP investments can be seen in tech companies with extensive patent portfolios, entertainment firms leveraging copyrights and trademarks, and pharmaceutical companies securing market exclusivity through patents.
Successful IP investment strategies include direct investment in IP assets, acquiring licensing rights, investing in IP-focused funds, and funding IP litigation in exchange for a share of proceeds.
